March 14, 2013: Civil Service Commission
MINUTES:

 
The Civil Service Commission of the City of Lyndhurst met in Regular Session on Thursday, March 14, 2013 at 8:30 a.m., in the Conference Room of the Lyndhurst Municipal Center, 5301 Mayfield Road.
 
Members Present:
Commissioners: R Schmidlin, Chairman; R Patete, R Sweeney
 
Others Present: P T Murphy, Director of Law; C J White, Secretary; R Porrello, Chief of Police; P Rhode, Executive Lt. Police Department
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete that the reading of the minutes of the Regular Meeting held February 14, 2013, copies of which were mailed to all members, be dispensed with and said minutes stand approved as circulated.
 
The question was put to a voice vote and passed unanimously.
 
Motion carried.
 
Review options for Original Appointment testing.
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that this item be tabled pending further information.
 
The question was put to a voice vote and passed unanimously.

Further review correspondence from Lt. Traci.
 
Mr. Schmidlin explained that the correspondence from Lt. Traci was read at the Regular Meeting of the Civil Service Commission, held February 14, 2013.
 
Mr. Murphy stated that he had done extensive research on the request to reinstate the seniority of Patrolman Scipione, and referenced Chapter 124.50 of the Ohio Revised Code, which states as follows: "Any person reinstated pursuant to the authority of this paragraph shall not seek credit for seniority earned prior to resignation and reinstatement, and shall not be entitled to reinstatement to a position above the rank of regular firefighter or patrol officer, regardless of the position the person may have held at the time of resignation." He stated that based on that paragraph, the Civil Service Commission does not have the power to grant the request of Lt. Traci.
 
Confirm Special Police Officer candidate, Scott Lillash.
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that pursuant to Section 14 (c) Rule IV, of the Rules and Regulations of the Civil Service Commission, Special Police Officer candidate Scott Lillash has completed requirements set forth in Section 14 (a) and (b) and is hereby certified for appointment as a Special Police Officer, which appointment shall become permanent upon completion of the required training as set forth by the Lyndhurst Police Department.
 
The question was put to a voice vote and passed unanimously.

Correspondence from Mayor Cicero.
 
The following correspondence was read Mr. Schmidlin:

Commissioners:
 
This is to advise that the Lyndhurst Police Department will have a position available for one patrol officer.
 
Therefore, I am hereby notifying you of the position to be filled and requesting that you certify to me the names and addresses of individuals from the original appointment Eligibility List for the Lyndhurst Police Department.
 
The position to be filled is for patrol officer and is a permanent position.
 
I would appreciate receiving the requested list as soon as possible. Thank you for your assistance and cooperation.

It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the Secretary be instructed to contact the first eight interested candidates from the Police Eligibility List established July 28, 2012, for background checks.
 
The question was put to a voice vote and passed unanimously.
 
Motion carried.
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete that the meeting be adjourned.
 
The question was put to a voice vote and passed unanimously.
