5487 Mayfield Road:
 
Request of Mr. Ron Basile, owner, to rezone his property from "Ten Thousand Square Foot Single Family" to "Class A, Community Business District."

MINUTES:

 
The Planning Commission of the City of Lyndhurst met in Regular Session on Thursday, March 22, 2012 at 7:30 p.m., in the Conference Room of the Lyndhurst Municipal Center, 5301 Mayfield Road. Mayor Joseph M. Cicero, Jr., presiding.
 
Members Present:
Commissioners: R S Febo, D J Sirk; J M Cicero, J A Marko
 
Member Absent:
Commissioner: V F DeCrane
 
Others Present: R Schmidlin; T P Kunz, Building Commissioner; C J White, Secretary.
 
It was moved by Mr. Sirk, seconded by Mr. Febo that the minutes of the Workshop Session held July 6, 2011, copies of which were mailed to all members, be dispensed with and said minutes stand approved as circulated.
 
The question was put to a voice vote and passed, with Councilman Marko abstaining.
 
Motion carried.
 
It was moved by Mr. Febo, seconded by Mr. Sirk that the minutes of the Special Meeting held July 26, 2011, copies of which were mailed to all members, be dispensed with and said minutes stand approved as circulated.
 
The question was put to a voice vote and passed with Councilman Marko abstaining.

5487 Mayfield Road
 
Request of Mr. Ron Basile, owner, to rezone his property from "Ten Thousand Square Foot Single Family" to "Class A, Community Business District."
 
Mr. Basile, owner of 5487 Mayfield Road, stated that he would like to live in the house residentially, but rezone the property to commercial in case a potential buyer is interested.
 
Mr. Febo stated he has no problems in rezoning this particular property to commercial, however, he would like to see a site plan, and more importantly, he would like to see the intent of a commercial purchaser, to determine if it is compatible and/or consistent with the Master Plan for the Mayfield Road corridor.
 
Mayor Cicero stated that the Commission would be hard pressed not to rezone that property due to the abutting properties zoned commercial.
 
In answer to Mr. Basile's question, Mayor Cicero explained which commercial uses cannot be in Lyndhurst.
 
In answer to Mr. Sirk's question, Mr. Kunz explained that in this particular area, along Mayfield Road from Sunview Road to Ford Road, the buildings that are not currently single family homes are all office building uses; Mr. Basile may want to pursue office building space.
 
Mr. Sirk stated his concern regarding traffic patterns with the existing curb cuts on this property along Mayfield Road, and because of that reason, would like to see a business use, or A-2 zoning for this parcel.
 
Mr. Kunz stated that the only difference between A-1 and A-2 is the total lot area and frontage area. He further stated that the property at 5487 Mayfield Road would be deficient in both areas due to the size of the lot. He further stated that rezoning it to A-1 commercial would be more conducive to the size of the lot. He then explained that if this lot were to be rezoned alone, it would be considered an existing, non-conforming lot.
 
After discussion, it was moved by Mr. Febo, seconded by Councilman Marko that recommendation be made to Council to deny the request of Mr. Ron Basile, owner, to rezone his property from "Ten Thousand Square Foot Single Family" to "Class A, Community Business District."
 
The question was put to a voice vote and passed unanimously.
 
Motion carried.
 
It was moved by Mr. Sirk, seconded by Mr. Febo that the meeting be adjourned.
