March 21, 2011: Safety Committee
MINUTES:

The Safety Committee met jointly with the Legislative Committee on, Monday, March 21, 2011, in the conference room at Lyndhurst Municipal Center. Present at the joint meeting were Safety Committee Members Gambatese and Ward and Chairman LoPresti, along with Legislative Committee Members Fry and Ward and Chairman Marko. Also present were Councilman Fisher, Law Director Murphy and Mayor Cicero. The Meeting was called to order at 7:15pm. The purpose of the meeting was to discuss Ordinance Nos. 2011-11 and 2011-12 and corresponding suggested changes to be made to Code Sections 1385.12(B) and 1387.021, respectively.

Specifically, the aforementioned Ordinances were proposed in an effort to address concerns that certain dwellings in the City having more than 4 floors, such as Sherrie Park Apartments, did not provide the requisite safety precautions to its residents.

The proposed amendment to Code Section 1385.12, by and through Ordinance No. 2011-11, would add the following language to the existing Code Section:

(B) Every dwelling structure four (4) or more stories in height, which has an elevator serving the structure, shall have a standby power system set inside the structure, which system shall be powered by fuel other than electricity, and which shall be capable of operating the elevator if there is an electrical failure in the building, or in the surrounding area.

The proposed change to Code Section 1387, by and through Ordinance No. 20011-12, would enact Code Section 1387.021, and would add the following language to the existing Code Section:

SECTION 1387.021 STANDBY POWER SYSTEM REQUIRED.

Every multiple dwelling structure four (4) or more stories in height, which has an elevator serving the structure, shall have a standby power system set inside the structure, which system shall be powered by fuel other than electricity, and which shall be capable of operating the elevator if there is an electrical failure in the building, or in the surrounding area.

A Motion was raised by Mr. Ward, seconded by Mr. Gambatese, for the Safety Committee to recommend to Council that Ordinance Nos. 2011-11 and 2011-12 be adopted. Similarly, a Motion was raised by Mr. Ward, seconded by Mr. Frey, for the Legislative Committee to recommend to Council that Ordinance Nos. 2011-11 and 2011-12 be adopted.

No other business was discussed and the joint meeting adjourned at 7:38pm

Respectfully,

Charles A. LoPresti, Safety Committee Chairman
Joseph A. Marko, Legislative Committee Chairman
