TRAFFIC CITATION AND PAYMENT GENERAL INFORMATION
 
WAIVERABLE
 
Waiverable is being able to pay a ticket without having to appear in Court. Your ticket is waiverable if you have not had more than two prior traffic violations in the past year. A waiverable ticket must be paid within seven days of the date of the ticket or a court appearance is required.
 
NON-WAIVERABLE
 
If your ticket is not waiverable, please appear in court on the date and at the time listed in the lower right hand corner of the ticket and be prepared to pay in full that day.
 
WHAT TO BRING WITH YOU
  • Adequate funds to pay the fines and costs. Payment in full is due immediately.

  •  
  • Proof of insurance.

  •  
  • A valid operators license or a valid renewed license.

  •  
  • Proof of vehicle ownership if your car was impounded.

PAYMENT
  • You can mail or pay in person a waiverable ticket during court hours.

  •  
  • The Lyndhurst Police Department accepts payment after 5:00 pm and on weekends and holidays.

  •  
  • The Court accepts cash, personal checks, or money orders.

  •  
  • Visa or Mastercard is accepted when paying in person during court hours only.

  •  
  • Out of state residents please pay by money order or cashiers check only

INSURANCE
 
If you did not provide valid proof of auto insurance to the police officer, a copy of your insurance card that covers the vehicle you were driving, on the date you were cited will be required when payment is made.
 
CONTINUANCES
 
There is an automatic one-week continuance on traffic citations if you cannot appear for the court date listed on the ticket. If you need a continuance beyond the one-week, you must contact the Court.

WAIVER PRICE LIST
 
The Violation Bureau in cases subject to such waiver effective shall assess the following Fines, Court Costs, Contributions to State Fund for Reparation to Victims of Crime and Cuyahoga County for the Criminal Justice Regional Information Service September 1, 2006.
 
The following shall be adopted as the Schedule of Fine and Costs for Waiverable Offenses at the Traffic Violations Bureau.

THE FOLLOWING TRAFFIC OFFENSES SHALL REQUIRE A COURT APPEARANCE:
  1. INDICTABLE OFFENSES.

  2. OPERATING A MOTOR VEHICLE WHILE UNDER THE INFLUENCE OF ALCOHOL OF ANY DRUG OF ABUSE.

  3. LEAVING THE SCENE OF ACCIDENT.

  4. DRIVING WHILE UNDER SUSPENSION OR REVOCATION OF DRIVER'S LICENSE.

  5. DRIVING WITHOUT BEING LICENSED TO DRIVE.

  6. A THIRD MOVING VIOLATION OFFENSE WITHIN A TWELVE-MONTH PERIOD.

  7. FAILURE TO STOP AND REMAIN STANDING UPON MEETING OR OVERTAKING A SCHOOL BUS STOPPED
    ON THE HIGHWAY FOR THE PURPOSE OF RECEIVING OR DISCHARGING A SCHOOL CHILD.

  8. WILLFULLY ELUDING OR FLEEING A POLICE OFFICER.

  9. DRAG RACING.

  10. WILFUL WANTON DISREGARD FOR SAFETY.

CIVIL AND SMALL CLAIMS GENERAL INFORMATION
 
CIVIL COMPLAINTS
 
The Lyndhurst Municipal Court’s Civil Division is responsible for handling general civil cases: personal injury, property damage, contracts, and forcible entry and detainer (evictions). The maximum you can seek is $15,000.
 
The filing fee for Civil complaints is $115.00 for the first defendant and $10.00 for each additional defendant.
 
All corporations are required to be represented by counsel.
 
SMALL CLAIM COMPLAINTS
 
Small Claims Court is used to resolve minor disputes. The cases are heard before Magistrate Elliott Resnick on Friday mornings. Monetary jurisdictional limit for claims is $3,000.00. The party being sued, or the defendant, must reside or have their place of business within the court’s jurisdiction or the incident must have occurred within the court’s jurisdiction.
 
Small claims forms and instruction booklets are available at the clerk’s office during regular business hours. Complete names of businesses or individuals as well as addresses including zip code and phone number must be furnished at the time of filing.
 
The filing fee for Small Claims complaints is $155.00 for the first defendant and $10.00 for each additional defendant.

GARNISHMENT
 
The filing fee for a wage garnishment depends on the amount of judgment. For judgment amounts of $3,000.00 and over, the fee is $95.00. For judgment amounts under $3000.00, the fee is $65.00. There is no longer a fee to the employer.

DIRECTIONS TO LYNDHURST MUNICIPAL COURT
 
Lyndhurst Municipal Court is located at 5301 Mayfield Road in Lyndhurst Ohio.
 
We are accessible from 271 north and south at the Mayfield Road west exit or at the Beachwood-Brainard-Pepper Pike exit respectively.
 
Take 271 north or 271 south to Mayfield Road west exit. Head west on Mayfield Road approximately 3 miles, after you cross over Brainard Road intersection, we are 1/4 mile west on the right hand side of the road.
 
Take 480 east to 271 north to Beachwood-Brainard-Pepper Pike exit. Make a left at the light which is Brainard Road and take to Mayfield Road, make a left on Mayfield Road. We are approximately a 1/4 mile west from Brainard Road on the right hand side of the road.
 
Coming from downtown Cleveland, take route 2 east to 90 east to 271 south to the Mayfield Road west exit. Head west on Mayfield Road approximately 3 miles, after you cross over Brainard Road intersection, we are on the right hand side of the road, approximately 1/4 mile.
