The Safety Committee will meet on Monday, October 4, 2010 at 7:00 P.M. to discuss establishing a procedure for billing to recoup the cost of emergency safety services rendered by the City.

MINUTES:

 
The Safety Committee met on Monday, October 4, 2010, in the conference room at Lyndhurst Municipal Center. Present at the meeting were Committee members Gambatese and Ward, and Chairman LoPresti. Also present were Councilmen Fisher, Schlessel, Marko and Frey, Mayor Cicero, Finance Director Kovalchik, and Law Director Murphy. The Meeting was called to order at 7:00pm.
 
The purpose of the meeting was to discuss the viability of passing legislation (Ordinance 2010-53) that would enable the City to establish a procedure for billing to recoup the cost of emergency safety services rendered by the City.
 
Finance Director Kovalchik provided the Committee with details of the proposed program, including estimated costs of services provided per occurrence, which would be paid by the billed party - not the City, and estimated associated collection rates. She also answered the Committee's questions in this regard. Director Kovalchik explained to the Committee and other attendees that the service fees for the delivery of emergency services, personnel, supplies and equipment to the scene of motor vehicle accidents will be initially charged to the responsible or "at fault" driver by way of their insurance carrier. She added that Lyndhurst residents are exempt from any out of pocket costs - they already pay for these services. Thereafter, the billing and collection of these service fees will be accomplished by way of a professional billing agency empowered by the City to do so.
 
A Motion was raised by Mr. Ward, seconded by Chairman LoPresti, for the Safety Committee to suggest to Council, that they adopt the legislation, Ordinance 2010-53, as drafted. The Motion passed 3-0.
 
No other business was discussed and the meeting adjourned at 7:21pm

MINUTES:

 
The Safety Committee met on Monday, May 24, 2010, in the conference room at Lyndhurst Municipal Center. Present at the meeting were Committee members Gambatese and Ward and Chairman LoPresti. Also present were Councilmen Fisher, Schlessel, and Frey, Finance Director Kovalchik, Police Chief Porrello and Law Director Murphy. The Meeting was called to order at 6:30pm.
 
The purpose of the meeting was to discuss the viability of passing legislation (Ordinance 2010-27) that would enable the City to install automated traffic enforcement cameras on South Euclid/Lyndhurst School District buses, for the purpose of issuing civil violations to drivers who disobey the bus' signals to stop during the loading and unloading of passengers. Changes to the current ordinance governing school buses (432.30) were also discussed, as well as the enacting of 432.301, in accordance with the same.
 
Chief Porrello provided the Committee details of the proposed program and answered the Committee's questions. Chairman LoPresti provided information on the difference between a Criminal Traffic Citation issued directly to the licensed operator of a motor vehicle and the Citations that would be issued as a result of the school bus related infractions caught on camera, which instead attach Civil penalties assessed to the registered owner of the vehicle involved in an infraction.
 
A Motion was raised by Mr. Ward, seconded by Chairman LoPresti, for the Safety Committee to suggest to Council, that they adopt the legislation, Ordinance 2010-27, as drafted, subject to certain changes suggested in the Safety Committee Meeting.
 
No other business was discussed and the meeting adjourned at 6:58pm
