The Civil Service Commission of the City of Lyndhurst met in Regular Session on Thursday, November 8, 2012 at 8:30 a.m. in the Police Chief's Conference Room in the Lyndhurst Municipal Center, 5301 Mayfield Road.
 
Members Present:

It was moved by Mr. Schmidlin, seconded by Mr. Patete, that the reading of the minutes of the Regular Meeting held October 11, 2012, copies of which were mailed to all members, be dispensed with and said minutes stand approved as circulated.
 
The question was put to a voice vote and passed unanimously.
 
Motion carried.
 
Revisit extending the Eligibility List for Chief in the Fire Department (Originally established November 3, 2010).
 
Mr. Schmidlin explained that this item was on the agenda last month, and the eligibility list for chief was extended for one year. However, after further discussion, it was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the eligibility list for chief, established November 3, 2010, be extended until February, 2013.
 
The question was put to a voice vote and passed unanimously.
 
Motion carried.
 
The following two agenda items were discussed as one.
 
Discuss adding military credit for original appointment and review proposed Resolution 2012-2.
 
Discussion continued on whether more points should be given to a candidate who was in active combat, and less to a candidate who was stationed somewhere in the United States. Further discussion was held on the amount of points a candidate should receive with an honorable discharge. Further discussed was candidates who served in the National Guard or Coast Guard, whether they are eligible for the military credit.
 
Chief Porrello stated that if points are given or not, the interview process will look favorably upon a candidate who has served their country honorably.
 
In answer to the secretary's question, Chief Porrello stated that the candidate would get the maximum points allowed for one honorable discharge. If the candidate served in the military and the Coast Guard for example, that candidate would only receive credit for one honorable discharge.
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the language in proposed Resolution 2012-2 read that three (3) points be awarded for military credit to a candidate upon submission of an honorable discharge or a DD-214.
 
The question was put to a voice vote and passed unanimously.
 
Motion carried.

Extend Original Appointment Eligibility List for Patrol Officer (Expires August 12, 2012).
 
Mr. Schmidlin recommended that the Original Appointment Eligibility list expire on August 12, 2012. The Commission concurred.
 
Discuss adding military credit for original appointment.
 
Mr. Schmidlin reviewed the history of the military credit given by the Lyndhurst Civil Service Commission in the early 1990s and a short time later, it was repealed.
 
Mr. Murphy presented proposed legislation, Resolution No. 2012-2, which provides for five (5) additional points given in an original appointment exam to an applicant who has served in the military service, as described in the Ohio R.C. 124.23, and who files a certificate of service or honorable discharge.
 
Discussion continued on the types of certificates that may be filed. Chief Porrello stated that he would do research on this issue, and present the findings at the next Civil Service meeting.
 
The Commission referred to Resolution 91-10, regarding language used for honorable discharges from military service.
 
In answer to Mr. Schmidlin's question, Chief Carroll stated he would like to give firefighter candidates the same extra credit for original appointment.
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that this item be tabled in order to prepare similar legislation for the original appointment exam for firefighters and pending further information and clarification for the terms "certificate of service" and "DD-214" and language explaining a dishonorable discharge.
 
The question was put to a voice vote and passed unanimously.

Discuss points v percentages for original appointment for fire department.
 
Chief Carroll stated that there is a difference between points and percentages based on original appointment exam and promotional exams in the fire department. He recommended that the scoring be consistent, using points.
 
Mr. Schmidlin requested that Section 6 of proposed Resolution 2012-2 be changed to reflect points for the fire department, instead of percentages.
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete to amend the agenda to reflect "Establish Eligibility List for Patrolman."
 
The question was put to a voice vote and passed unanimously.

Review ad for original appointment exam for patrolman
 
New language which was suggested by Chief Porrello was added into the ad and presented to the Commission for their review.
 
Chief Porrello stated that the sixth paragraph should be read: "No person who has been convicted of or committed a felony, a crime of violence, or who has a significant history of illicit drug offenses or usage should apply.
 
The Commission added two new paragraphs recommended by Chief Porrello to the ad, which will be reviewed and finalized at a Special Meeting.
 
It was decided that the test date will be July 28 instead of July 21. It was also decided that the ad will be placed in the Plain Dealer for two consecutive Sundays, beginning with July 1, and the Sun Messenger for one Thursday, and depending on the cost, The News Herald.
 
Extend Original Appointment List for Patrolman (expires July 12, 2012).
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete that the Original Appointment List for Patrolman be extended to August 12, 2012.
 
The question was put to a voice vote and passed unanimously.

Discuss necessity of the fifteen (15) additional points given for Ohio Peace Officers' training.
 
In answer to Mr. Schmidlin's question, Chief Porrello stated that almost all applicants do have the Ohio Peace Officers' training. He recommended that the number of points for the training be reduced to ten (10) which will give candidates who do not have the OPATA training a better chance to get higher on the eligibility list. He further stated that it would give the City the option in the future to send a good candidate without the training to the police academy. He further stated that by giving educational points to the candidates, it creates conditions that will give us better candidates higher up on the eligibility list.
 
Ms. Sweeney stated that she feels it is better to reduce the points to ten (10) and not make it a requirement to have the certification to take the original appointment test.
 
The Commission concurred, and will make a final decision at a meeting to take place at a later date.
 
Review proposed draft legislation for educational credits for original appointment and promotional exams in the Police Department.
 
Mr. Murphy distributed proposed Resolution No. 2012-1, amending Rule IV, Section 6 of the rules of the Civil Service Commission.
 
Chief Porrello stated he agrees with the wording in the proposed resolution in regards to five (5) points being given to candidates who have an associate's degree or higher providing they first receive the established passing grade.
 
Mr. Murphy clarified that according to the proposed resolution, five (5) points will be given to a candidate with an associate's degree and five (5) additional points will be given to a candidate with a bachelor's degree. He then asked the Commission if they would like to limit the type of degree to something relevant to police work.
 
Chief Porrello stated that he would recommend five (5) points total for educational credit; an associate's degree or higher. He further stated that, in his opinion, a degree in any field will make a better candidate.
 
It was recommended that the recommended changes made to the proposed resolution be reviewed at the next meeting.
 
Discussion continued on condensing the ad, the wording of the ad, and whether to add that additional points will be given for education, OPATA training and SPOs.
 
Discuss available positions for SPOs.
 
In answer to Mr. Schmidlin's question, Chief Porrello stated the SPO candidates are still in the selection process. He further stated that after conducting background checks, there are three viable candidates.
 
Discussion continued on the Commission's role in hiring SPOs.
 
Mr. Schmidlin stated that the candidates' information had been reviewed by the Commission.

Discuss composition of the Original Appointment test for patrolman.
 
Chief Porrello stated that he had met with Mr. Paul Michalko,ersonnel Selection Services, to discuss incorporating a writing component into the written test for those candidates who score in the top twenty.
 
Mr. Schmidlin encouraged Chief Porrello to continue discussions with Mr. Michalko on this subject.
 
In answer to Ms. Sweeney's question regarding the possible difficulty of having the candidates come back for another portion of the test, Chief Porrello stated that if the writing portion is required, and if the candidate is really wants the job, it will be his/her responsibility to make themselves available for each phase of the test.
 
In answer to Mr. Patete's comment regarding listing the writing and/or reading portion of the written test for the top scoring candidates in the information packet, the secretary stated that the police index, which is also a required phase, is not listed, and questioned whether this additional component should be listed.
 
Chief Porrello also stated that the reading portion of the test, if so approved, would be weighted, and incorporated into the initial entrance exam; only the writing skills component would be added.
 
Mr. Schmidlin stated he would like to see the writing portion implemented for the top twenty candidates, and that this be mentioned into the information packet. The Commission concurred.
 
Discuss Original Appointment test for patrolman.
 
Chief Porrello stated he would like to see two questions on the application for the upcoming patrolman's test: Tri-C physical agility dated for no longer than one year and ask if the applicant knows anyone that works for the City of Lyndhurst.
 
Ms. Sweeney stated that at the time of application submittal, the Physical Agility certificate is reviewed to make sure it is no more than one year since the test. Regarding Chief Porrello's comment requesting the candidate disclose people he knows that work for the City, she stated that it wouldn't be pertinent to getting on the eligibility list.
 
Chief Porrello submitted to the Commission, for their approval, two paragraphs regarding driving violations and convictions he would like placed in the ad.
 
Discussion took place regarding fifteen (15) additional points for candidates who have successfully completed and maintained certification from an Ohio Peace Officers Training Commission, whether or not to retain the additional points, or make the training mandatory prior to submitting an application. Ms. Sweeney recommended that the ad should reflect the five (5) additional points to be given to current Special Police Officers as well (see Rule IV, Section 6).
 
Mr. Schmidlin recommended that a maximum of 125 applications be accepted.
 
In answer to Mr. Schmidlin's comment regarding additional credit for education, Chief Porrello stated that none has been given in the past; however, he would like to review and discuss the issue at some point.

Mr. Schmidlin stated that the twelve (12) candidates below have had background checks, and have been reviewed by the Commission.
 
Mr. Patete stated that some of the candidates have reached their thirty-fifth (35) birthday. According to the ORC, Section 124.41, candidates, upon appointment, cannot have met their thirty-fifth (35) birthday.
 
Chief Porrello stated that given the fact that no candidate is beyond a year or so over the age of thirty-five (35), he is not opposed to changing the age requirement.
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete, that the Civil Service rule, Rule III Section 4, regarding the maximum age requirement for the original appointment for police officer, be waived for this list.
 
The question was put to a voice vote and passed unanimously.

The Civil Service Commission of the City of Lyndhurst met in Regular Session on Thursday, March 8, 2012 at 8:30 a.m., in the Conference Room of the Lyndhurst Municipal Center, 5301 Mayfield Road.

It was moved by Mr. Schmidlin, seconded by Mr. Patete that the reading of the minutes of the Regular Meeting held February 9, 2012, copies of which were mailed to all members, be dispensed with and said minutes stand approved as circulated.

It was moved by Mr. Schmidlin, seconded by Mr. Patete that the Original Appointment List for Patrolman in the Lyndhurst Police Department, established March 18, 2010, and extended to March 18, 2012, be extended for a period of more additional year.
 
The question was put to a voice vote and passed unanimously.
 
Motion carried.
 
In answer to Chief Carroll's question, Mr. Murphy stated that the Commission can let the extended list expire prematurely. He further stated that once a new test is given, and a new list is established, the prior list automatically expires.
 
Mr. Schmidlin withdrew his previous motion and Mr. Patete withdrew his second.
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete that the Extension of the Original Appointment List for Patrolman in the Lyndhurst Police Department, established March 18, 2010, be tabled pending further review of the rules.
 
The question was put to a voice vote and passed unanimously.

Discuss adding a reading portion to the Original Appointment Exam for Patrolman.
 
In answer to Mr. Schmidlin's question, Chief Porrello stated that the reading portion of the test would be for reading comprehension.
 
Mr. Patete suggested a report writing element also be included in the original appointment exam for police.
 
It was decided that Chief Porrello discuss these issues with Paul Michalko of Personnel Selection Services, and report back to the Commission at the next meeting.
 
Discuss educational points for original appointment exam for patrolman.
 
Mr. Schmidlin stated that he would like to keep the scoring of both the police and fire the original appointment exams consistent. He further stated he would also like to score both consistently; currently, promotional testing for the fire department uses points. He then recommended that the law director draft legislation for review. He also recommended that the secretary forward copies of resolutions to the Commission members regarding firefighter original appointment scoring and promotional scoring in the fire department.
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the meeting be adjourned.

The Civil Service Commission of the City of Lyndhurst met in Regular Session on Thursday, February 9, 2012 at 8:30 a.m. in the Conference Room of the Lyndhurst Municipal Center, 5301 Mayfield Road.

Meet with Paul Michalko of Personnel Selection Service.
 
Mr. Michalko addressed the Commission and stated he has conducted both police and fire exams for the City of Lyndhurst for the at least the past fifteen years. He explained that each test given is a new test, so that people cannot memorize the test. He also stated that the tests his company gives can be customized to the department.
 
In answer to Mr. Schmidlin's question, Mr. Michalko distributed a current price list of written examinations for police and fire departments.
 
In answer to Mr. Patete's question regarding candidates lacking integrity, Mr. Michalko recommended that integrity and moral questions be asked during the screening process, or have the top twenty-five candidates take a more extensive test, after the entry level written test. He further stated that there are two different levels of testing that his company does, and it is based on difficulty level; some cities require high school level, others require college.
 
In answer to Chief Porrello's question, Mr. Michalko stated the following topics are on an entry level police test: observation and memory, understanding written material, interpersonal relations, following written instructions, verbal reasoning, logic, and mathematical aptitude. He then reiterated that the tests can be customized to the department, and also many of the topics can be covered in the screening process. He explained that moral/psychological testing is difficult to score.
 
In answer to Ms. Sweeney's question, Mr. Michalko stated that there is a pool of over two thousand questions, and each test has about one hundred twenty-five questions on an entry level test, so it is not likely a candidate will be able to memorize the tests, even if he or she has taken quite a few tests.
 
In answer to Chief Carroll's question regarding people with disabilities taking the test, Mr. Michalko stated that his company does cover that issue, and has alternates available for the disabled. He further stated that any request for special accommodations should require a written confirmation from a professional.
 
Regional testing for original appointment was discussed.
 
In answer to Chief Porrello's question regarding the age of the original appointment list, Mr. Michalko stated in his opinion, there are good and qualified candidates way down on the list as well as candidates that are in the top ten.
 
Mr. Michalko passed out business cards and thanked the Commission for hearing his presentation.

The two page form that was distributed prior to the meeting was discussed, and it was decided that this application be used for both police and fire original appointment exams. Minor changes will be made as to the dates and whether it is for police or fire.

Chief Porrello asked the commission if they would consider giving extra credit to police candidates for college.
 
Mr. Patete stated that years ago there was extra credit for college, however, it was difficult to determine which colleges were accredited and/or which were still in business. He further stated that verifying the college credit takes an exorbitant amount of time.
 
Chief Carroll stated that extra credit is given to fire candidates, if they hold specific degrees, which are outlined in the Rules of the Civil Service Commission.
 
Review Rule VI. Section 1
 
Mr. Schmidlin explained that this rules deals with the time frame that applicants have to respond back to the city. He further stated that he interprets that to mean that the rule applies to the appointing authority once the certified list is submitted. He then stated that the rules are liberal enough, and the applicant is obligated to stay in contact with the city, that seven (7) is sufficient.
 
Chief Porrello explained that the detective bureau also has waited a lengthy time for candidates to respond during the background check process and asked if those rules apply to the entire process.
 
Mr. Schmidlin stated there are no rules specific to that process. He also recommended that a letter be sent to the candidate stating that they are no longer being considered for this appointment.
 
Mr. Murphy recommended a reasonable amount of time, deemed by the detective bureau for the process to move along.
 
Secretary White stated that the detective bureau would like a letter and signature on file, stating that a candidate is no longer interested in the appointment.
 
Mr. Schmidlin recommended that the Civil Service Commission send a letter after a reasonable amount of time (from one to fourteen days) stating the contact dates and using the term, "by the lack of your response, your application is no longer being considered at this time. If this is in error, please contact us by this date" - and give the candidate three or so additional days.
 
Discuss upcoming original appointment police exam.
 
Mr. Schmidlin explained that depending on the outcome of the current list, a new original appointment police exam may wait until later in the year. He further stated that the current list will expire on March 18, 2012, at which time the Commission can extend the list.

It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the Original Appointment List for Fire Department, established February 10, 2011, be extended for a period of one year.

Mr. Schmidlin explained that there is a need for a total of three patrolmen, due to the resignation of two patrolmen. He further stated that the current list expires March 18, 2012.
 
Due to the hardship the department is facing, Chief Porrello recommended hiring two patrolmen from the existing list, and hiring one from the new list, once established. He further explained that he is not concerned at the number the list is at; he is more concerned with the test scores of the candidates, which are still high. He further stated that a candidate's high ranking may be due to a lot of test taking as well. He then recommended a review of the actual written test to determine if there is room for improvement.
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that a list of twelve candidate names be created to hire two for original appointment in the police department.
 
The question was put to a voice vote and passed unanimously.
