MINUTES:

 
The Civil Service Commission of the City of Lyndhurst met in Regular Session on Thursday, December 15, 2011, at 8:30 a.m. in the Conference Room of the Lyndhurst Municipal Center, 5301 Mayfield Road.
 
Members Present: R. Schmidlin, Chairman; D. Patete, R. Sweeney
 
Others Present: P T Murphy, Director of Law; R. Porrello, Chief of Police; M. Carroll, Fire Chief
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the reading of the minutes of the Regular Meeting held November 10, 2011, copies of which were mailed to all members, be dispensed with and said minutes stand approved as circulated.
 
The question was put to a voice vote, and passed unanimously.
 
Motion carried.
 
At this time, Mr. Murphy administered the Oath of Office to Ms. Sweeney, to renew her term on the Civil Service Commission.
 
Review and amend firefighter application for original appointment.
 
Mr. Schmidlin explained that the newer application for firefighters has become increasingly lengthy, inconsistent with other cities and would like to reduce the number of pages of the original appointment application for firefighters.
 
Included in the Commission's packet, was a redacted application from 2004, which is a two sided application.
 
Mr. Schmidlin offered his opinion, stating that the in depth personal information can be obtained if the candidate is called for a background check.
 
Chief Carroll stated he would be in favor of going back to the two page format, but would like to add a few things to the two page original appointment application. He further explained the reason he would like to see a shorter original application form is that there are only a few requirements needed to actually take the firefighters' exam, and the lengthy application is not needed at that point.
 
Chief Porrello stated that Chief Carroll will defer with Lt. Alexander regarding the information needed on the original appointment application. He further stated that he would like to see the original appointment application for police be similar.
 
In answer to Ms. Sweeney's question, Mr. Murphy stated he feels the minimum information is necessary to show that the candidate is qualified to take the exam.
 
Ms. Sweeney suggested that both the two page original appointment application and the extensive original appointment application be reviewed due to the changing employment laws.
 
It was decided that a draft of the two page original appointment application will be presented at the next regular meeting in January.
 
It was recommended by Mr. Schmidlin that the next agenda item be discussed last.

Review and amend firefighter application for original appointment.
 
Mr. Schmidlin stated that the application used now is extensive, and is up for discussion now, to find if the application can be shortened for registering for the test, then possibly the top ten or twenty people would fill out the extensive application (application and background information form). He also suggested that the application be filled out, paid and submitted on line.
 
Chief Carroll suggested that the application be filled out on line, printed then submitted in person because the rules say that applications must be submitted in person, and because a thumb print of the applicant and an application fee is taken upon submittal of the application. He also stated that he would discuss the entire application with Detective Alexander, to find out what exactly is needed, prior to the next meeting.
 
A sample draft original appointment application will be forwarded to the commissioners for review prior to the next meeting.
 
Review rules of the Civil Service Commission
 
Mr. Schmidlin explained that there are some inconsistencies in the rules of the Civil Service Commission. He recommended that the members of the Commission and the Law Director review the rules and amend if necessary.
 
It was recommended that the Secretary distribute a current copy of the rules, along with any resolutions passed after June 28, 2011, to each member to review.
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete that the meeting be adjourned.

Mr. Schmidlin stated there is an existing eligibility list with six names on it. The names on the list are: Grant Cruxton, Ryan Mackey, John Catani, Samuel Matthews, Christopher Hayes and Lee Schoch.

Mr. Schmidlin stated that the agenda should reflect the approval of the July 14, 2011 minutes, not the minutes of the Regular meeting held June 9, 2011, which were already approved.
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the minutes of the Regular Meeting held July 14, 2011, copies of which were mailed to all members, be dispensed with and said minutes stand approved as circulated.

Discuss Eligibility List for promotionals in the Police Department (originally established November 6, 2008).
 
Chief Porrello explained that an ordinance had recently passed by City Council to add one more sergeant and eliminating one lieutenant. He further stated that more than likely a promotion will take place prior to the current list expiring.
 
In answer to Chief Porrello's comment, it was decided by the Commission to let the current list for promotionals in the Police Department expire.
 
Discuss Seminar:
 
The Future of Civil Service in Ohio, given by Clemens, Nelson & Associates.
 
Chief Carroll previously distributed information on the seminar to the Commissioners, and stated that if Senate Bill 5 passes, changes will be made to the pay structure of police and fire personnel, and thought it may be beneficial for the Commissioners to attend.
 
Mr. Schmidlin stated that if anyone would like to attend, to contact the secretary.

Resolution No. 2011-01
 
Review proposed Resolution 2011-01 regarding scoring promotional exams in the fire department.
 
Mr. Murphy explained that the resolution distributed today is a draft which includes the recommended changes suggested by the Commission. He further explained that it is the Commission's desire that points be used to score the promotional tests, instead of percentages.
 
Mr. Schmidlin stated there are a few minor changes to the proposed resolution, and that he would relay those changes to the Law Director in the near future. He further stated that this proposed resolution will be voted on at the next regular meeting.
 
Chief Carroll stated that Firefighter Sam Brown is resigning from the fire department as of mid-October. He further stated that Firefighter Brown was a great employee, but has an opportunity to work in his family's business. He further stated that if Firefighter Brown chooses to take a leave of absence, the mayor could grant that leave of absence for thirty days, and the Commission could extend that leave of absence for one year; however he has not yet requested a leave of absence.
 
In answer to Ms. Sweeney's question regarding the impact a leave of absence would have on the department, Chief Caroll stated that there would be a lot of overtime. He further stated that Firefighter Brown will give him an answer regarding a leave of absence at the beginning of next week. He further stated that there is a current eligibility list, and would like to hire as soon as possible.
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete that the meeting be adjourned.

Regarding the minutes of June 9, 2011, the first paragraph after the heading and explanation of proposed Resolution No. 2011-01, Mr. Patete recommended that it should read, "In answer to Mr. Patete's inquiry, Mr. Murphy explained that throughout the resolution, the words 'final point scale' should be 'final point score.' "
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the reading of the minutes of the Regular Meeting held June 9, 2011, copies of which were mailed to all members, be dispensed with and said minutes stand approved as amended.

Proposed Resolution 2011-02
 
A resolution amending Rule III, Section 4, of the Rules of the Civil Service Commission as they appear in Chapter 171 of the Codified Ordinances of the City of Lyndhurst.
 
Mr. Schmidlin explained that this rule was first amended by City Council with Ordinance No. 2011-39, passed July 5, 2011. Proposed Resolution No. 2011-02 reflects the changes to be adopted by the Commission members. He further explained that adopting this resolution would keep the Lyndhurst Civil Service Rules consistent with the Ohio Revised Code in regards to the age of a newly hired firefighter, raising the age from 31 to 36, providing the candidate meets certain disability and pension criteria.
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete that proposed Resolution 2011-02, Section 4., be amended to read " . . . No applicant for the position of firefighter shall be eligible for appointment to a position by the Mayor subsequent to the applicant's thirty-first birthday, EXCEPT AS PROVIDED IN SECTION 143.05 (b) OF THE CODIFIED ORDINANCES OF THE CITY.

Proposed Resolution No. 2011-01
 
Review proposed Resolution No. 2011-01, regarding scoring promotional exams in the fire department.
 
Mr. Murphy explained that throughout the resolution, the words "final point scale" should be "final point score."
 
Ms. Sweeney recommended that in Section 7, fourth paragraph, third and fourth lines, the word "percentage" should be deleted. She further recommended that paragraph three include the words "or education," to read "No credit for seniority "OR EDUCATION" shall be added to an examination grade . . ." and that paragraph three be moved to the end of Section 7 and above Section 2.
 
In answer to Ms. Sweeney's question regarding the education of ranks, Chief Carroll explained the reasoning behind the extra credit for various degrees and specifics of education shown on the proposed resolution.
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the changes stated be incorporated into the final draft of Resolution No. 2011-01 to be reviewed for approval at the next regular meeting.

Discuss points v percentages in original appointment and promotional exams for the safety forces.
 
Mr. Murphy explained that this issue pertains only to promotional exams in the fire department.
 
The Commission discussed the attachments to the agenda, which were minutes and legislation previously passed regarding this issue, which Mr. Murphy explained.
 
Mr. Patete feels that using percentages will weight the final score, and stated using points would be fair. Ms. Sweeney concurred, stating that percentages give candidates and advantage if they score higher on the test. She further stated that everyone should be treated equally for the same degree, which would happen under the points system, but not the percentage system.
 
Chief Carroll explained that during the past discussions, three proposals were submitted to the Commission, and the Commission chose to go with former Chief Telzrow's proposal.
 
Discussion continued about the amount of credit a candidate would get for higher education, and the discrepancies of higher education credits between ranks.
 
It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the Law Director is directed to prepare a proposed amendment to 2010-6, for a working draft that will change the percentage points to final grade points and in addition, to change the firefighter/paramedic to lieutenant language from an associate degree or higher in fire science.

Review protest and response to Fire Lieutenant's promotional exam, held February 16, 2011.
 
The Commission reviewed the report from the Ohio Fire Chiefs' Association regarding a protest of the written examination for Lieutenant in the Fire Department.
 
The Secretary presented the written examination and answer key for the Lieutenant's exam for review.
 
The Commission reviewed Question #22, the answer key and the text from which the question was taken. The protest as submitted by the candidate was read by the Chairman.
 
Firefighter Procop, the candidate who submitted the protest was present and explained that he felt that in referring to the text, only half of the sentence was referenced in the test, and had the entire sentence been referenced, it would have greatly changed the question.
 
Chief Carroll stated that given the response by Chief Talcott, of the Ohio Fire Chiefs' Association, the answer is the "most correct" answer, and then stated he concurs with Chief Talcott.
 
Ms. Sweeney felt it would be fair if the question was thrown out.
 
It was moved by Mr. Schmidlin, seconded by Mr. Patete that the Commission uphold the decision of Chief Talcott on Question #22, to disallow the protest.
 
The question was put to a voice vote and passed with Ms. Sweeney voting no.

Approve scores of the written exams and assessment centers for the promotional testing of Lieutenant and Captain, and establish list in the Fire Department.
 
The Commission reviewed the grades for the recently administered examination for promotion in the Fire Department. Also reviewed was the report from Chief Talcott of the Ohio Fire Chiefs' Association regarding the assessment center.
 
Following discussion, it was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the grades in the recently administered promotional examinations in the Fire Department be approved as presented.

    Discuss Application for Reinstatement - Lyndhurst Police Department.
     
    Mr. Schmidlin stated there are three letters in regards to an application for reinstatement of former Patrolman Michael Scipione. He stated that he has read the letters in detail, and all necessary requirements have been met, and the rules of the Civil Service Commission, in accordance with, Rule IX, Section 5 have been followed.
     
    Mr. Patete stated that former Patrolman Michael Scipione has been examined by the city's medical doctor and the city's psychologist, and passed both exams.
     
    Chief Porrello stated that a process was devised and throughout that process found that all testing came back positive. He further stated that former Patrolman Scipione, if the Commission approves the reinstatement, will be an asset to the department, as he was before.
     
    It was moved by Mr. Schmidlin, seconded by Mr. Patete to accept the Mayor's recommendation to accept the Application for Reinstatement of Michael Scipione, in accordance with Rule IX, Section 5 of the Lyndhurst Civil Service Rules.

    Discuss Promotional Testing for Lieutenant and Captain in the Lyndhurst Fire Department.
     
    Chief Carroll submitted a letter to the Commission regarding the upcoming promotional test in the fire department, and highlighted it.
     
    Chief Carroll recommended that the scoring on the Lieutenants' test be as follows:
     
    60% written test
    40% assessment center
     
    He further recommended that the Captains' test be scored as follows:
     
    40% written test
    60% assessment center

    In answer to Mr. Patete's question, Chief Carroll stated that he doesn't feel the building preplans are accurate enough to be on the test. Chief Carroll then stated that he would consider putting the city handbook and the current contract on the test. He further stated that although 18 firefighters are eligible to take the Lieutenants Test, he believes only about 7 will actually take the test, and although 3 lieutenants are eligible to take the captains test, only 2 will actually take that test.
     
    Mr. Patete stated his concern about the competitiveness of the captains test, asking that if one fails the written test, would there be an assessment center for the one that passed the written test.
     
    Chief Carroll stated that he recommends on the lieutenants' test, there be a minimum passing grade of 70% on the written, but on the captains' test, due to that specific concern, the 70% passing grade be removed.
     
    It was moved by Mr. Schmidlin, seconded by Ms. Sweeney that the recommendations made by Chief Carroll in his letter to the Commission dated December 27, 2010, be approved for testing and assessment center dates and scoring of the upcoming promotional exams in the Lyndhurst Fire Department, contingent upon the removal of "minimum 70% to pass" and "must pass written to take assessment center" on the lieutenants' test, so as to be consistent with the captains' test, which shows no minimum score.
     
    The question was put to a voice vote and passed unanimously.
     
    Motion carried.
     
    Firefighter Ryan Procop referred to the newly adopted education points in the promotional exams, and requested that the extra credit points for education be deferred to a later testing date due to budget cuts within the city to pay for overtime and/or education.
     
    Firefighter Ford concurred, stating that doing away with the adopted resolution on education points for this upcoming promotional test would put most candidates on an even playing field, but that those who qualify would receive the seniority points.
     
    Mr. Schmidlin stated that a lot of time and thought was put into the resolution for educational credits, and one of the things discussed was the timeliness of the passage.
     
    Chief Carroll stated that classes can be taken more so now, due to availability of city and grant monies.
     
    Mr. Patete stated that he feels it wouldn't be right to change the rules dependent on the applicants' educational statuses or certain and unique situations.
     
    Mr. Schmidlin recommended that the request to suspend the rules on educational credits be declined.
     
    Discuss background checks of police candidates.
     
    The members of the Commission have previously reviewed the background checks and law enforcement indexes of twelve police candidates. The members of the Commission discussed the law enforcement indexes of those twelve police candidates in detail with Detective Norm Alexander.
     
    It was moved by Mr. Schmidlin seconded by Mr. Patete that the police candidates move to the next step in the process.
     
    The question was put to a voice vote and passed unanimously.
